1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and HOOC AI TECHNOLOGIES PVT LTD (“Company”, “we”, “us”, or “our”), governing your access to and use of Hoocup, including our mobile applications, web portals, APIs, background cognitive synthesis jobs, and associated services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must cease using the Service immediately.

2. Eligibility

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use Hoocup. If you are under 18 years of age, you represent that you have obtained consent from a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3. Nature of the Service & Emotional AI Disclaimers

Hoocup provides an Artificial Emotional Intelligence (AEI) platform, Digital Human Interface (DHI), and personal companion designed for empathetic dialogue, daily reflection, and contextual personal memory.

4. Anti-Dependency Charter & Ethical Safeguards

Unlike conventional engagement-driven platforms, Hoocup is explicitly engineered to discourage unhealthy emotional dependency. Our companion agents are programmed to recognize isolation spirals, encourage real-world human social bonds, and maintain full transparency that conversations are generated by machine intelligence.

5. User Accounts & Security

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your credentials confidential. You are solely responsible for all activities occurring under your account. Notify us immediately if you suspect unauthorized access.

6. User Content & Zero-Knowledge Ownership

You retain 100% ownership of your content. All thoughts, journal entries, voice recordings, and memories you enter into Hoocup remain exclusively yours.

We operate on zero-knowledge encryption protocols. We do not inspect, browse, sell, or exploit your personal diary. Furthermore, we do not train public foundation AI models on your private personal interactions.

7. Automated Daily Cron Syntheses & Background Updates

Hoocup incorporates automated background processes and scheduled cron syntheses (e.g., nightly memory consolidation, reflection summaries, and adaptive tone recalibration). By using the Service, you grant Hoocup the computational permission to perform these client-side and secure-enclave automated syntheses solely on your behalf.

8. Prohibited Conduct

When using Hoocup, you agree that you will not:

• Use the Service for illegal, fraudulent, harassing, defamatory, or harmful purposes.
• Attempt to reverse-engineer, decompile, extract source code, or breach cryptographic security layers.
• Scrape, crawl, or abuse our APIs beyond authorized rate limits or intended companion interfaces.
• Probe, scan, or test the vulnerability of any Hoocup system, network, or enclave without prior written authorization.
• Misrepresent the identity of the AI or attempt to generate malicious deepfakes or harmful synthetic content.

9. Subscriptions, Payments & Cancellation

Certain advanced companion models, high-fidelity DHI video streaming, and expanded storage may require a paid subscription. Billing terms, renewal frequencies, and cancellation policies are clearly displayed prior to purchase. You can cancel your subscription at any time through your account settings or app store provider.

10. Data Rights, Export & Account Termination

You maintain absolute control over your digital footprint. At any time, you can exercise your self-service rights directly within the Hoocup mobile app under Settings > Data & Memory:

• Export Data: Download your comprehensive conversation transcripts and synthesized memory vectors in machine-readable JSON format.
• Selective Memory Deletion: Purge specific conversational topics, dates, or emotional clusters with immediate cryptographic erasure.
• Account Termination: Permanently delete your account and all associated zero-knowledge cryptographic keys with zero retention delay.

11. Intellectual Property Rights

All software, logos, trademarks (including “Hoocup”, “HOOC AI”, “AEI”, “DHI”), graphical user interfaces, visual designs, patents, and algorithmic topologies are the exclusive property of HOOC AI TECHNOLOGIES PVT LTD. You are granted a limited, personal, non-transferable license to use the Service as intended.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF UNINTENDED SYNTACTIC HALLUCINATIONS COMMON TO GENERATIVE ARTIFICIAL INTELLIGENCE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOC AI TECHNOLOGIES PVT LTD, ITS DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts situated in New Delhi, India.

15. Modifications to Terms

We reserve the right to revise or update these Terms periodically. We will provide notice of significant changes by updating the “Last Updated” date or through an in-app alert. Your continued use of Hoocup following notice indicates acceptance of the amended Terms.
